Nick Carter Says He Was in Las Vegas — Not Florida — on Date of Alleged Assault


Nick Carter says he was more than 2,500 miles away from his accuser, Ashley Repp, on one of the dates she claims he sexually assaulted her, according to court documents obtained by Us Weekly.

On Wednesday, January 7, the Backstreet Boys singer filed new legal papers asking a judge to throw out Repp’s lawsuit, arguing that her claims are impossible based on verified evidence of his whereabouts.

What Repp Alleged

Repp sued Carter in 2023, accusing him of sexually assaulting her three times in 2003, when she says she was 15 years old. In her lawsuit, she acknowledged that the dates she provided were estimates, describing them as “approximations” and saying the alleged assaults occurred “on or about” those dates.

One of the alleged assaults, according to Repp, took place on October 27, 2003, on a yacht in Marathon, Florida.

Carter’s Defense

Carter, now 45, has strongly denied all accusations. In the new filing, his lawyers say the October 27 claim cannot be true because Carter was not in Florida that day. Instead, they say he was attending the 2003 Radio Music Awards in Las Vegas, Nevada.

His legal team says Carter was photographed at the awards show and also appeared at related events the day before, placing him more than 2,500 miles away from where Repp claims the assault occurred.

Deposition Dispute

According to Carter’s lawyers, Repp repeatedly insisted during her lawsuit filings, sworn declarations, and deposition testimony that October 27, 2003, was the correct date. During her deposition, she reportedly said it was “absolutely not” possible that the date was wrong.

However, when confronted with evidence showing Carter was in Las Vegas, Repp acknowledged that she may have made a mistake.

“I was almost certain that the date was October 27, 2003,” she said, according to the filing. “It is quite possible that I may have gotten that date incorrect.”

Carter’s attorney responded by noting that Repp had spent nearly an hour testifying that the date was accurate. The lawyer added that Repp ultimately conceded it would have been impossible for Carter to assault her on that day as alleged.

Additional Claims and Allegations

In his filing, Carter asked the court to dismiss all of Repp’s claims against him, including sexual battery, intentional infliction of emotional distress, and negligent infliction of emotional distress.

Carter’s legal team also pointed to statements Repp allegedly made to law enforcement in 2004, claiming she admitted she had lied about her age and said her sexual encounters with Carter were consensual.

The singer further alleged that Repp is working with his two other accusers, Shannon Ruth and Melissa Schuman, to make false claims in an effort to force a financial settlement. All three women have denied conspiring together.

Carter’s Position

Carter has consistently denied all allegations against him. His lawyers describe Repp as a longtime fan and claim that her own friends testified she deliberately lied to Carter and his family about her age.

The court has not yet ruled on Carter’s request to dismiss the case.
